The dark body along with the black and yellow banded legs suggest the species in the top picture is Polistes metricus.

They can be confused with the darker versions of the Northern Paper wasp, however, P. metricus often have little to no yellow markings on the body.

Their territory ranges throughout much of the Eastern United States.
